Texas GOP Governor Greg Abbott To Let Citizens File Suit Against God

One of Texas’ most recent laws — Senate Bill 8, signed into law 19 May 2021 — which essentially turns the general public into vigilantes, and establishes a subjective quid pro quo, presuming — without evidence — that a woman is: 1.) Pregnant, and; 2.) That she’s undergone a legal, private, medical procedure – an abortion — is so bizarre that it defies imagination.

The Lone Star State’s Banana Republican Governor, a wheelchair-bound crippled hypocrite named Greg Abbott, also most recently deflected in a most bizarre manner when asked a question by a reporter September 7, 2021:

“Why force a rape or incest victim to carry a pregnancy to term?”

The Governor replied, saying:

“Aaah… it doesn’t require that at all, because it, obviously, it provides at least six weeks… aaah, for  a person, aaah… to be able to, aaah… get an abortion. So for one, it doesn’t provide that. That said, however, let’s make something very clear: Rape… is a crime. And Texas will work tirelessly to make sure that we eliminate all rapists from the streets of Texas, by aggressively going out and… ah… arresting them, and prosecuting them, and, and getting them off the streets. So, goal number one in the state of Texas, is to eliminate rape, so there’s no woman, no person, will be a victim of rape.”

The also-crippled-in-the-head Guvnah Greggy-poo gives a good straw man argument defense. The reporter should have followed up by asking how the law reduces rape.

And just to remind readers what a “straw man argument” is, it goes like this:

A ‘straw man’ — an effigy, a fictitious, make-believe, person-like character — is established, and then, verbally pummeled as being the responsible party for whatever ails or problems exist. The ‘straw man’ needn’t be a person, of course, but it helps. A ‘straw man’ could be sharks, such as “sharks are the cause of death in oceans, not only because they eat fish and other animals like seals, but are known to kill and eat humans, as well. Therefore, sharks are evil, and because sharks will eat your babies, and your pregnant women, sharks must be killed… because sharks kill and eat babies and pregnant women… and the elderly. You don’t want your granny eaten by a shark, do you? Save your babies! Save your pregnant women! Save your granny! KILL ALL SHARKS!” The speaker establishes an effigy, and verbally pummels it, INSTEAD OF directly addressing the question.

While that example of a straw man argument should suffice to demonstrate the speciousness of such rhetorical devices, it should also be borne in mind that

Can just anybody, or even the state, sue, or arrest and charge with a crime anyone who discussed abortion, was referred for, or had an abortion — even if it was out of the state of the patient’s residence?

How “long” is the “long arm of the law,” and can it actually investigate, charge, prosecute, and punish physicians and/or patients for receiving private healthcare advice and/or services?

Suddenly! Yes, suddenly — as in acutely, and even cataclysmically-like-an-earthquake so — physicians and other healthcare professionals seem to find themselves between a proverbial rock, and a hypothetical hard place.

The reason why, is because 6 GOP-nominated radicals on the still-9-member Supreme Court of the United States (SCOTUS) {Those justices are: Alito, Thomas, CJ Roberts, Kavanaugh, Gorsuch, and Barrett.} have completely ignored judicial precedent — which is the “holy grail” of jurisprudence that helps form the foundation of law itself, and thereby give stability to civil society — and overturned at least TWO rulings of an earlier court — Roe v Wade (1973), and Planned Parenthood v. Casey (1992) — in their 6-3 decision in Dobbs v. Jackson Women’s Health Organization (2022).

Of course, overturning even century-old precedent has been the characteristic hallmark of the Roberts Court. Since becoming Joker in Chief Justice in September 2005, he has presided over 20 reversals of well-established precedented opinion, some dating as far back as 1911. If, in the law, nothing is TRULY ever settled, and any court now, or in the future, can simply overturn any law or decision with which they disagree — regardless of how long it’s been in effect, and regardless of what their confirmation testimony was — then our nation’s foundation is insecure.

There are numerous Constitutional problems with the 6 radicalized jurists’ decision, not the least of which is that, by returning to the states the ability to decide abortion law (or any other law over which Federal law has presided), it completely ignores undermines and usurps the essential tenet of the Constitution’s Supremacy Clause, which is that Federal law has ultimate authority over any other law by a state, or locality.

To add insult to injury, Associate Justice Clarence Thomas — long known as “The Silent Justice,” because from Wednesday, February 22, 2006, until Monday, February 29, 2016 — 10 years — he NEVER spoke one word at hearings — wrote in Dobbs that judicial activists could also overturn other recent cases such as Griswold v. Connecticut, Obergefell v. Hodges, Lawrence v. Texas, and other decisions with which they personally disagree.

On page 3 of his opinion (page 119 of 213 of the entire document), he wrote in part that,

“…in future cases, we should reconsider all of this Court’s substantive due process precedents, including Griswold, Lawrence, and Obergefell. Because any substantive due process decision is “demonstrably erroneous,” Ramos v. Louisiana, 590 U. S. ___, ___ (2020) (THOMAS, J., concurring in judgment) (slip op., at 7), we have a duty to “correct the error” established in those precedents, Gamble v. United States, 587 U. S. ___, ___ (2019) (THOMAS, J., concurring) (slip op., at 9). After overruling these demonstrably erroneous decisions, the question would remain whether other constitutional provisions guarantee the myriad rights that our substantive due process cases have generated. For example, we could consider whether any of the rights announced in this Court’s substantive due process cases are “privileges or immunities of citizens of the United States” protected by the Fourteenth Amendment.”

Justice Thomas continued in part by writing,

“That 50 years have passed since Roe and abortion advocates still cannot coherently articulate the right (or rights) at stake proves the obvious: The right to abortion is ultimately a policy goal in desperate search of a constitutional justification.”

He predicates his entire opposition to the ruling in Roe upon but one idea: His distaste for the term

When asked today (Sunday, 03July2022) by Dana Bash, CNN News Anchor, and Chief Political Correspondent about the matter excerpted and linked below, South Dakota’s GOP Governor Kristi Noem refused to answer a direct question about a real-life situation, if it were to have occurred in South Dakota.

The matter is a very real one, and it is the tragic sexual abuse of a 10-year old girl who became pregnant as a result of that abuse, and was referred by a Child Abuse physician in Ohio to an OBGYN colleague in Indiana.

These matters, while previously in the realm of the fictitiously surreal, as in “The Handmaid’s Tale” — a dystopian 1985 novel by Canadian author Margaret Atwood, in which a militaristic totalitarian theocracy has overthrown the United States government, as the story’s plotline explores themes of the women subjugated by the extremist, oppressive government, and the various ways by, and through which they gain agency in that society — sadly, have now become reality.

“Praise God!” -OR- “God Damn!”? You be the judge.

Today (June 26, 2022), the much-expected, leaked Supreme Court decision in Dobbs v. Jackson Women’s Health Organization (19-1392) was publicly released on the Supreme Court’s website [see: https://www.SupremeCourt.gov/opinions/21pdf/19-1392_6j37.pdf], which the unjust Justice Samuel Alito summarized thusly:

“The Constitution does not confer a right to abortion; Roe v. Wade, 410 U. S. 113, and Planned Parenthood of Southeastern Pa. v. Casey, 505 U. S. 833, are overruled; the authority to regulate abortion is returned to the people and their elected representatives.”

The 6 right-wing radicals similarly ignored the Constitution’s 9th Amendment, which is the statement that unenumerated rights exist:

“The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.”

Six Justices, including the Joker in Chief Justice John G. Roberts, Jr., and ultra-right-wing radical extremists Brett Kavanaugh, Samuel A. Alito, Jr., Clarence Thomas, Neil M. Gorsuch, and Amy Coney Barrett — all whom were nominated by Banana Republicans — overturned a very-nearly 50-year precedent.

By so doing, they made themselves out as liars, because ALL of the 6 in public testimony before the Senate Judiciary Committee, asserted that Roe v. Wade, a decision issued on January 22, 1973, was “settled law.”

A Radicalized Supreme Court

Democratic senators say if the Supreme Court strikes a blow against Roe v. Wade by upholding a Mississippi abortion law, it will fuel an effort to add justices to the court or otherwise reform it.

The Supreme Court’s conservative majority this week agreed to hear the Mississippi case, which could dramatically narrow abortion rights by allowing states to make it illegal to get an abortion after 15 weeks of pregnancy.

“It will inevitably fuel and drive an effort to expand the Supreme Court if this activist majority betrays fundamental constitutional principles,” said Senator Richard Blumenthal (D-Conn.), a member of the Senate Judiciary Committee.

“It’s already driving that movement,” he added.

Senator Blumenthal said it doesn’t mean that a Congress led by Democrats would immediately be able to add justices to the court, but he suggested it would add momentum to reform efforts at a minimum.

“Chipping away at Roe v. Wade will precipitate a seismic movement to reform the Supreme Court. It may not be expanding the Supreme Court, it may be making changes to its jurisdiction, or requiring a certain numbers of votes to strike down certain past precedents,” he said.

No one knows for sure when the Supreme Court will hand down its decision on the Mississippi abortion law, but it is widely expected to hear arguments after it convenes in October. That could set up a decision next year.

Rhode Island Senator Sheldon Whitehouse (D), another member of the Judiciary Committee, said the court’s review of the Mississippi law raises serious concerns.

“It really enlivens the concerns that we have about the extent to which right-wing billionaire money has influenced the makeup of the court and may even be pulling strings at the court,” he said.

“We’ve got a whole array of options we’re looking at in the courts committee,” Senator Whitehouse said of the Presidential Commission on the Supreme Court of the United States, which President Biden established by executive order in April.

I’d like to address this entry to Governor Lee, and to every other person who, for whatever reason, opposes abortion – though opposition to the procedure is mostly religious-based, and that itself presents a Constitutional problem, insofar as our nation is not established upon any religion, and I mean specifically to refer to the “Establishment clause” of the First Amendment. I am NOT going to argue religion, that is for theologians, and I am not making a theological argument.

First, it is a very dangerous precedent to write a law that not only eliminates one’s ability to make an independent, and informed decision (about that, or any other private matter), but mandates that the government tell you (or anyone) what to do in your private life. That is the essence of what is happening with this type of argument. Proponents are: 1.) Forbidding exercise of Constitutional rights and freedom to make a free-will decision, and; 2.) Essentially forcing the pregnant woman to give birth to the child.

Regardless of whether one agrees, or not, that abortion should be discouraged, or even made illegal, the essence of what is happening is that, when government gets involved in a personal, private matter, there is no longer just a woman, and her physician, in that private treatment room, but 535 other people – 435 Representatives, and 100 Senators. And that’s just too many people in one small room.

Whenever government steps in and makes decisions for you, you no longer have freedom, you no longer have liberty. And whether they realize it, or acknowledge it, or not, that’s what the anti-abortion activists want – for government to make your decision, or more accurately, to deny you the ability to make a decision… one with which they disagree with upon religious grounds. Not only is that is the VERY antithesis of so-called “smaller, less intrusive” government (something about which GOP types have clamored about), but it is “Big Brother” government, another thing about which most right-wing, and GOP-type folks complain.

Here are a few thoughts and three points about so-called “fetal heartbeat” bills enacted by AL & a handful of other states:

1.) Our U.S. Constitution does NOT support the notion that a fetus is a person because – and as the Catholic Church has long taught – life begins at birth, NOT conception. We chose to have a funeral and now have a spot in a Blacksburg cemetery where we can visit her whenever we are near. Having a gravesite, I know, was a huge help in the grieving process for Matt.

This is private, but I am going to put it out there to put a face on an issue for some of my friends.

On Tuesday, I lost two great sources of hope for the future. One was the election, but the other was more personal. Midday, before the polls ever closed, and right as I was returning one turf to Headquarters to pick up another, I got a phone call that brought me to my knees.

I was pregnant, ya’ll. I was 11 weeks on Election Day, and it had been a dicey start, but we thought we had made it. We were already discussing adorable ways to make it FB official. Elections are supposed to be about real people — and not the ones whose names appear on the ballot. They are supposed to be about all of us, the policies that will impact our lives in tangible ways and the choices we make about the country we want to be.

But this year, we have watched a major candidate for our country’s highest office demean and slander whole categories of American citizens. We have watched him make offensive, outrageous claims about real people and real decisions that everyday Americans face. People like me. Decisions like mine.

What sent me to my computer to write is late-term abortion. As I heard Donald Trump talk about babies being “ripped” from their mothers’ wombs, as if ending a pregnancy is a reckless, irresponsible afterthought, my outrage poured down my face in angry tears. In those moments, Trump, who has never been pregnant and presumably has navigated this far in his life without undertaking any difficult, gut-wrenching, gray-area decisions, used my own pain — deep, deep pain — to advance his political agenda.

But his words won’t tell my story, so I’ll tell it here. I don’t often speak about this experience. And I’ve never written about it until now.

According to the Alan Guttmacher Institute, and the Centers for Disease Control, abortions are performed at a significantly higher rate in racial/ethnic minority communities (Negro & Hispanic) than in the White/Anglo majority community.

Having read an item on the website Black Community News about legislation sponsored by Ohio State Representative Bill Patmon (D, 10th House District, Cleveland) that would “block state funding” to Planned Parenthood, I thought it important to share some notes, observations and thoughts on the topic presented therein.

The Sweet Salvation That A Little Old Knife Can Bring

I don’t recollect exactly what year it was when I first heard the song “Woman Child” by the late singer/songwriter artist/musician Harry Chapin. I do recollect, however, that a young lady then near my age, was a fan of his, and it was through hearing some of his music she was playing that I learned of him.

It was perhaps his 1978 album “Living Room Suite” which I had seen her playing, but it was his second album “Sniper and Other Love Songs,” released in October 1972, which I subsequently purchased, which so powerfully affected me.

Chapin died tragically in July 1981, aged 38, and though the exact cause of his death was undetermined, he was thought to have suffered cardiac arrest while driving, which was explained as the likely cause of his wreck. The truck driver into whose path he swerved, along with the assistance of a passer-by, rescued him from his burning 1975-model Volkswagen Rabbit, and he was subsequently flown to a nearby hospital where a team of perhaps 10 or more worked fruitlessly for nearly a half-hour to save his life.

Chapin’s artistic creative style might be considered similar, somewhat, to that of a troubadour or wandering minstrel, because each and every song on that album – and indeed, every song of his – was a well-crafted, and expertly told story. The stories weren’t from a fantastic, idealistic fantasy life, but were from everyone’s work-a-day life. The struggles, trials, tribulations, joys, victories and crushing blows of unjust defeats in life were all subjects in his songs. From “W – O – L – D,” to one of his best-known “Cat’s In The Cradle,” Chapin’s gift of lyric and music made each song a veritable raconteur’s masterpiece.

When Obamacare compelled businesses to include emergency contraception in employee health care plans, Hobby Lobby, a national chain of craft stores, fought the law all the way to the Supreme Court. The Affordable Care Act’s contraception mandate, the company’s owners argued, forced them to violate their religious beliefs. But while it was suing the government, Hobby Lobby spent millions of dollars on an employee retirement plan that invested in the manufacturers of the same contraceptive products the firm’s owners cite in their lawsuit.

Documents filed with the Department of Labor and dated December 2012—three months after the company’s owners filed their lawsuit—show that the Hobby Lobby 401(k) employee retirement plan held more than $73 million in mutual funds with investments in companies that produce emergency contraceptive pills, intrauterine devices, and drugs commonly used in abortions. Hobby Lobby makes large matching contributions to this company-sponsored 401(k).

Several of the mutual funds in Hobby Lobby’s retirement plan have stock holdings in companies that manufacture the specific drugs and devices that the Green family, which owns Hobby Lobby, is fighting to keep out of Hobby Lobby’s health care policies: the emergency contraceptive pills Plan B and Ella, and copper and hormonal intrauterine devices.

These companies include Teva Pharmaceutical Industries, which makes Plan B and ParaGard, a copper IUD, and Actavis, which makes a generic version of Plan B and distributes Ella. Other stock holdings

In essence, here’s what today’s SCOTUS ruling in the Hobby Lobby case means:

Because of extremist, right-wing religious radicals, women are again being relegated to second class citizens, WITHOUT full rights and being further  victimized by having access denied to birth control/oral contraceptives – i.e., Ortho Novum 777, progesterone, estrogens, etc. – NOT abortion.

Those medications also treat other diseases exclusive to women, including polycystic ovarian disease, endometriosis, amenorrhea/ dysmenorrhea, etc.

The question before the court was this:

Body parts and bodies in freezers and refrigerators, corpse mutilation… all in the “City of Brotherly Love.””

Dr. Kermit Gosnell’s murder trial will be starting it’s sixth week, and with testimony such as:
Defense attorney Jack McMahon (heatedly): “After Digoxen and having its neck cut, you’re telling the jury that you saw the baby moving?”
Kareema Cross, 28-year-old employee from 2005 to 2009: “Yes, it was.”
– it doesn’t look good for the former physician, or for his untrained, unlicensed staff.

Why Dr. Kermit Gosnell’s Trial Should Be a Front-Page Story

The dead babies. The exploited women. The racism. The numerous governmental failures. It is thoroughly newsworthy.

The grand jury report in the case of Kermit Gosnell, 72, is among the most horrifying I’ve read. “This case is about a doctor who killed babies and endangered women. What we mean is that he regularly and illegally delivered live, viable babies in the third trimester of pregnancy – and then murdered these newborns by severing their spinal cords with scissors,” it states. “The medical practice by which he carried out this business was a filthy fraud in which he overdosed his patients with dangerous drugs, spread venereal disease among them with infected instruments, perforated their wombs and bowels – and, on at least two occasions, caused their deaths.”Charged with seven counts of first-degree murder, Gosnell is now standing trial in a Philadelphia courtroom. An NBC affiliate’s coverage includes testimony as grisly as you’d expect. “An unlicensed medical school graduate delivered graphic testimony about the chaos at a Philadelphia clinic where he helped perform late-term abortions,” the channel reports. “Stephen Massof described how he snipped the spinal cords of babies, calling it, ‘literally a beheading. It is separating the brain from the body.’ He testified that at times, when women were given medicine to speed up their deliveries, ‘it would rain fetuses. Fetuses and blood all over the place.'”One former employee described hearing a baby screaming after it was delivered during an abortion procedure. “I can’t describe it. It sounded like a little alien,” she testified. Said the Philadelphia Inquirer in its coverage, “Prosecutors have cited the dozens of jars of severed baby feet as an example of Gosnell’s idiosyncratic and illegal practice of providing abortions for cash to poor women pregnant longer than the 24-week cutoff for legal abortions in Pennsylvania.”

Until Thursday, I wasn’t aware of this story. It has generated sparse coverage in the national media, and while it’s been mentioned in RSS feeds to which I subscribe, I skip past most news items. I still consume a tremendous amount of journalism. Yet had I been asked at a trivia night about the identity of Kermit Gosnell, I would’ve been stumped and helplessly guessed a green Muppet. Then I saw Kirsten Power’s USA Today column. She makes a powerful, persuasive case that the Gosnell trial ought to be getting a lot more attention in the national press than it is getting.

The media criticism angle interests me. But I agree that the story has been undercovered, and I happen to be a working journalist, so I’ll begin by telling the rest of the story for its own sake. Only then will I explain why I think it deserves more coverage than it has gotten, although it ought to be self-evident by the time I’m done distilling the grand jury’s allegations. Grand juries aren’t infallible. This version of events hasn’t been proven in a court of law. But journalists routinely treat accounts given by police, prosecutors and grand juries as at least plausible if not proven. Try to decide, as you hear the state’s side of the case, whether you think it is credible, and if so, whether the possibility that some or all this happened demands massive journalistic scrutiny.

Alabama ranked as the nation’s second most religious state in 2012, behind Mississippi and tied with Utah, according to a new survey by Gallup.

The Washington, D.C.-based polling firm found that 56 percent of Alabama residents identified themselves as “very religious” – based on saying religion is an important part of their daily life and that they attend religious services every week or almost every week.

A 30-year study by the pro-abortion Alan Guttmacher Institute revealed that “Black women account for 37% of abortions, non-Hispanic White women for 34%, Hispanic women 22% and women of other races 8%.”
Minorities account for 67% of all abortions, while those same non-White populations account for about 1/3 (33%) of the American population.
According to the Centers for Disease Control, 57.4% of the abortions performed in Georgia in 2006 were performed on African-American women, but Blacks make up only 30% of Georgia’s population. Nationwide, the pattern is similarly stacked against Black babies — Black women have approximately 37% of all abortions each year, while Blacks make up only 13% of the national population.

WEST PHILADELPHIA – January 19, 2011 (WPVI) — A doctor who gave abortions to minorities, immigrants and poor women in a “house of horrors” clinic was charged with eight counts of murder in the deaths of a patient and seven babies who were born alive and then killed with scissors, prosecutors said Wednesday.
