CDA Section 230 violates Equal Protection Clause & threatens National Security

There’s been a significant amount of handwringing over remarks made by so-called “free speech” advocates who assert that anyone can say anything online “because it’s ‘free’ speech,” and ostensibly protected by the First Amendment.

I demur.

Facebook, Instagram (owned by FB), and Twitter, which are the “Big Three” online Social Media (SoMe) corporate megaliths (that is, if Twitter survives Elon Musk, if not, then TikTok may take Twitter’s place), have increasingly come under fire in the past several years — justifiably so — for turning a blind eye to bad behavior, “speech” in particular (as writing and/or video, both mediums posted on the services), thereby, in essence, becoming purveyors of lies, complicit by their inactions, in aiding and abetting actions of bad actors, consequently harming our nation — a significant portion of which continues originating in nations hostile to American national interests.

Writing in the Global Security Review, June 10, 2019, in an article entitled “Facebook, Compromised: How Russia Manipulated U.S. Voters” — the second of a four-part series — Sophia Porotsky detailed how Russia, as a malign foreign actor, sought, and continues seeking, the downfall of the United States.

“Russian Information Warfare content on social media attempts to subvert Western democracies in five ways:

1.) Undermine public confidence in democratic government;
2.) Exacerbate internal political divisions;
3.) Erode trust in government;
4.) Push the Russian agenda in foreign populations, and;
5.) Create confusion and distrust by blurring fact and fiction.

Russian propaganda on social media can be divided into four themes:

1.) Political messages intended to foster distrust in government (e.g. allegations of voter fraud, corruption);
2.) Financial propaganda (i.e. create distrust in Western financial institutions);
3.) Social issues (e.g. ethnic tensions, police brutality), and;
4.) Doomsday-style conspiracy theories.

“Information warfare content is generated and disseminated through channels that fall into three attribution categories:

1.) White (overt);
2.) Grey (less-overt), and;
3.) Black (covert) channels.

They propagate a blend of authentic, manipulated, and fake stories and they feed off of and reinforce each other.”

Among the numerous sources cited was “Russia’s Approach to Cyber Warfare,” a paper written by Michael Connell and Sarah Vogler published March 2017 by the Center for Naval Analyses (CNA) — an 80-year, independent, nonprofit research and analysis organization dedicated to the safety and security of the nation that informs the decisions of Navy, Marine Corps and DOD leaders as the Department of the Navy’s federally funded research and development center — which stated that,

“Russia views cyber very differently than its western counterparts, from the way Russian theorists define cyberwarfare to how the Kremlin employs its cyber capabilities.” Part of that difference is that the Russians “conceptualize cyber operations within the broader framework of information warfare, a holistic concept that includes computer network operations, electronic warfare, psychological operations, and information operations.”

And as part of their overall operations in that realm, not only does Russia “employ cyber as a conventional force enabler,” they integrate cybercriminals, hacktivists, and other nefariously malign non-state actors into their overall operations scheme, a practice also undertaken by “China, Iran, North Korea, and other cyber adversaries.”

That information is further borne out by the writings of Professor Dr. Mark Galeotti, PhD, who in June 2022 was recently banned from travel to Russia, wrote an OpEd in the independent news journal The Moscow Times, published December 22, 2017, that, “It is hard to sustain a serious claim that NATO tanks are about to surge eastwards – though some of the Kremlin’s more fanciful propagandists do try – but the virtues of the “secret battlefield” of intelligence work is that it is precisely covert.”

Dr. Galeotti is an internationally-recognized expert in security politics, intelligence services and criminality of modern Russia, is a Senior Non-Resident Fellow of the Institute of International Relations Prague, an Associate Fellow at the Council on Geostrategy, Honorary Professor at the UCL School of Slavonic and East European Studies, Honorary Professor at University College London, and Executive Director and principal in Mayak Intelligence, a London-based consultancy specializing in, and primarily focusing upon understanding organized and transnational crime, war, politics and history in Russia. Dr. Galieotti is also a contributing member of the Network of Experts of the independent civil-society organization Global Initiative Against Transnational Organized Crime, headquartered in Geneva, Switzerland.

The perverse irony of that matter, is that the English word “meta,” as spoken, is the Hebrew word for “dead.”

The Hebrew word מֵ֣ת (mêṯ) is a verb, in the perfect, third person tense, and is the singular of מוּת (muth) meaning “to die,” or “to kill.”

That’s entirely appropriate, of course, considering that the company has conducted internal research which has conclusively proven that Facebook’s secret algorithms have caused suicides in pre-teens, especially little girls.

In 2007, Jeff Bezos, then a multibillionaire and now the world’s richest man, did not pay a penny in federal income taxes. He achieved the feat again in 2011. In 2018, Tesla founder Elon Musk, the second-richest person in the world, also paid no federal income taxes.

Typical Americans his age paid more in taxes than they saw in wealth growth over that period.

For every $100 of wealth growth from
2006 to 2018,

Bezos paid only $1.09.

Michael Bloomberg managed to do the same in recent years. Billionaire investor Carl Icahn did it twice. George Soros paid no federal income tax three years in a row.

ProPublica has obtained a vast trove of Internal Revenue Service data on the tax returns of thousands of the nation’s wealthiest people, covering more than 15 years. The data provides an unprecedented look inside the financial lives of America’s titans of business, including Warren Buffett, Bill Gates, Rupert Murdoch and Mark Zuckerberg. It shows not just their income and taxes, but also their investments, stock trades, gambling winnings and even the results of audits.

Taken together, it demolishes

The Cornerstone myth of the American tax system:

That everyone pays their fair share and the richest Americans pay the most.

The IRS records show that the wealthiest can — perfectly legally — pay income taxes that are only a tiny fraction of the hundreds of millions, if not billions, their fortunes grow each year.

Many Americans live paycheck to paycheck, amassing little wealth and paying the federal government a percentage of their income that rises if they earn more. In recent years, the median American household earned about $70,000 annually and paid 14% in federal taxes. The highest income tax rate, 37%, kicked in this year, for couples, on earnings above $628,300.

The confidential tax records obtained by ProPublica show that the ultrarich effectively sidestep this system.

To capture the financial reality of the richest Americans, ProPublica undertook an analysis that has never been done before. We compared how much in taxes the 25 richest Americans paid each year to how much Forbes estimated their wealth grew in that same time period.

We’re going to call that their true tax rate.

The results are stark. According to Forbes, those 25 people saw their net worth rise a collective $401 billion from 2014 to 2018. They paid a total of $13.6 billion in federal income taxes in those five years, the IRS data shows. That’s a staggering sum, but it amounts to a true tax rate of only 3.4%.

It’s a completely different picture for middle-class Americans, for example, wage earners in their early 40s who have amassed a typical amount of wealth for people their age. From 2014 to 2018, such households saw their net worth expand by about $65,000 after taxes on average, mostly due to the rise in value of their homes. But because the vast bulk of their earnings were salaries, their tax bills were almost as much, nearly $62,000, over that five-year period.

No one among the 25 wealthiest avoided as much tax as Buffett, the grandfatherly centibillionaire. That’s perhaps surprising, given his public stance as an advocate of higher taxes for the rich. According to Forbes, his riches rose $24.3 billion between 2014 and 2018. Over those years, the data shows, Buffett reported paying $23.7 million in taxes.

That works out to a true tax rate of 0.1%, or less than 10 cents for every $100 he added to his wealth.

In the coming months, ProPublica will use the IRS data we have obtained to explore in detail how the ultrawealthy avoid taxes, exploit loopholes and escape scrutiny from federal auditors.

Experts have long understood the broad outlines of how little the wealthy are taxed in the United States, and many lay people have long suspected the same thing.

But few specifics about individuals ever emerge in public. Tax information is among the most zealously guarded secrets in the federal government. ProPublica has decided to reveal individual tax information of some of the wealthiest Americans because it is only by seeing specifics that the public can understand the realities of the country’s tax system.

Consider Bezos’ 2007, one of the years he paid zero in federal income taxes. Amazon’s stock more than doubled. Bezos’ fortune leapt $3.8 billion, according to Forbes, whose wealth estimates are widely cited. How did a person enjoying that sort of wealth explosion end up paying no income tax?

Once again, Ted Cruz turns in a great performance, and quite possibly may be nominated for a Daytime Emmy Award for the same.

A reminder:
While he was in high school, Ted’s parents talked him out of moving to California to pursue an acting career. So he said in a November 2013 interview with the Boston Globe.

But yesterday, the Asshole from Texas, aka Republican Senator Ted Cruz, made an ass out of himself.

No surprise there, eh?

Nobody likes Cruz. Recall that in 2016, former Speaker of the House, Republican John Boehner (OH-8) called him “Lucifer in the flesh.” Additional diatribes against Cruz may be found at the conclusion of this article.

Ted WILL make a run for the Presidency again, so he’s just posturing. After all, it IS election season, and even though he’s not on an election ticket, per se, he is on the ticket. And just 2 years ago (2018), Cruz just barely escaped being replaced by Democratic challenger Representative Beto O’Rourke (TX-16) – 50.9% to 48.3% of 8,371,655 ballots cast.

In fact, the entire GOP slate is on the ticket nationwide this year. And so far, it’s not looking good. It didn’t look good yesterday, either. The “optics” aren’t good, goes the saying about political appearances.

The Senate Commerce Committee conducted a Full Committee Hearing on Wednesday, October 28, 2020, 10:00 a.m. which was entitled, “Does Section 230’s Sweeping Immunity Enable Big Tech Bad Behavior?”

What is Section 230?

In short, Jeff Kossett describes it as the “26 words that created the Internet.”

Who is Jeff Kossett?

Jeff Kossett is Assistant Professor of Cybersecurity Law at the United States Naval Academy in Annapolis, Maryland, and is one of the nation’s foremost experts on Section 230. Regarding the law, he said, “Section 230 set the legal framework for the Internet that we know today that relies heavily on user content rather than content that companies create. Without Section 230, companies would not be willing to take so many risks.”

The law, written in 1996, modified the 1996 Communications Decency Act, is short, sweet, and to the point.

Section 230(c)(1) reads:

“No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.”

But this hearing was pure grandstanding from the get-go.

I did not write this but it’s exactly what i’ve been questioning.  This is what i want answers too.  We need to push “leaders” to give answers and make decisions that make sense long  term.    When does quality of life out weights the risk of a disease you have a 99.97% of getting?

What is the end game with the ‘rona? Anyone? 🦠

What is the magic formula that is going to allow us to sound the “all clear?” [There is NO “magic formula.”] Is it zero cases? For a while, the goal was to simply “flatten the curve,” but now that we are disconnecting utilities for gatherings in California, setting up check points in New York, and recommending goggles (what’s next?), it seems as if there is, in fact, no end game. And, truthfully, the only way that we will see numbers drop is if we cease testing and stop reporting. [That is a blatantly asinine, and ignorant remark. It’s like telling people if we stop testing for pregnancies, and counting births, the population will decline.] Keep in mind that hundreds of thousands have shown up to be tested, registered, left due to long waits, and still come up positive when they received their results.🤷🏼‍♀️[That remark suggests that tests are fabricated then falsified – that the results are fraudulent – and that a wholesale deceptive criminal enterprise exists throughout the entire testing chain, everywhere in all locations nationwide.]

I need to say something, not because I want to get political, but because I know the truth and I need to tell it.

The now-national story about Roy Moore and Leigh Corfman is true, and I have known it for over 20 years. Leigh’s mother and step-father have been friends of mine since 1992 and I know them to be the best of people. We don’t share the same political beliefs but we love and respect each other on a level deeper than politics and these wonderful friends tell the truth. They are caring and educated and accomplished people who would choose privacy over headlines any day.

Leigh’s mother told me and others “The Roy Moore Story” in the mid-1990s, because her daughter had finally unburdened herself after years of silence and that burden lay dark and deep on a mother’s shoulders and in that mother’s heart. I listened to the same details as those that are printed now, and while some of the story has faded with time, several facts are seared into my brain: 1) the attacker was attorney Roy Moore and the victim was then teenager Leigh Corfman; 2) Roy Moore got Leigh to his house under false pretenses; 3) Roy Moore made overt sexual advances to Leigh which involved Roy Moore coming out of the bathroom undressed and ready for action; 4) Leigh was terrified and had the good sense to say NO and Roy Moore accepted her NO.

During Roy Moore’s political ascent, I’ve almost called Leigh’s mother many times to suggest that they expose who Roy Moore is at his core, but I realize that this story is Leigh’s to tell… no one else’s. Why has she not exposed him before now? Perhaps because no one likes being called a liar – and she is being called that now. Perhaps because that secret was safer locked away from the pain that she must be reliving now and having to deal with all over again.

Whatever it is, it is NOT a political conspiracy. Leigh’s parents bleed Republican red as long as I have known them…and Leigh says she has voted Republican in the last three elections. While this story has the “He said, She said” element, surely the counterbalance on the scales in Leigh’s favor is US…the group of friends who knew the story before it was a headline. There was simply no reason for Leigh to make this story up when she was young and trying to figure out life. Roy Moore’s terrifying advances surely had to complicate the path that she admitted was filled with choices she would like to redo. She owned them, admirably, but I wonder if some of her young years might have been easier if she hadn’t been abused by Roy Moore when she was 14 years old, vulnerable and confused.

Perhaps it’s simply that it’s time to shout from the rooftops that this man, Roy Moore…who wants our nation’s trust and our belief that he is a good man… simply doesn’t deserve our trust. He lied yesterday when he said he had never met Leigh Corfman. Maybe he’s gotten too old to act on his abnormal urges now, but in his heart, he still knows that when he could, he scared and emotionally scarred young women and in that chamber of his heart, his blood still runs mean and cold.

I believe in redemption and forgiveness. I’ve asked for forgiveness many times in my life, but first, you have to acknowledge that you did something wrong. And yesterday Roy Moore stood staunch and unyielding that he did no wrong. Take a lie detector test, Mr. Moore. There’s nothing fake in this story. Roy Moore is lying. This story happened and it was shared mother-to-mother with no agenda other than to get it off her chest and share her agony. Women friends do that, thankfully. Leigh’s mother told me this story when Roy Moore was a nobody…now he’s just a lying somebody.

Just because Leigh Corfman didn’t come forward and tell this horrific story about a bad man until now, doesn’t mean that it never happened. It’s her story. Yes, it was a long time coming, but

The “Me Too” meme is, in large part, a response to recent revelations of Hollywood Motion Picture/Television Producer Harvey Weinstein’s longtime sexual abuse of women, in close succession to, and conjunction with revelations of similar long-term abuse by late Fox News CEO Roger Ailes, comedian Bill Cosby who is accused of chronic use of “date rape drugs“ on women, and former U.S. Rep. Anthony Weiner (D-NY, 9) who plead guilty to transferring obscene material to a minor for “sexting” (sending sexually explicit images, aka “dick pics”) to a 15-year-old girl with whom he connected via Twitter.

Women decided to show the world how many of them have been victimized sexually.

Men have also been sexually abused – as adults and as children – just like women.

However, sexual abuse just happens to be more prevalent among women.

In Response to John Goodwin’s FaceBook Post

A man named John Goodwin made a public post on FaceBook, which also included a link to an OpEd published in the Washington Post on November 9, 2016, which was written by Charles Camosy (PhD, University of Notre Dame), and entitled “Trump won because college-educated Americans are out of touch.” Dr. Camosy is an Associate Professor of Theological and Social Ethics at Fordham University, and the author of a book entitled “Beyond the Abortion Wars: A Way Forward for A New Generation.”

Mr. Goodwin’s FaceBook profile is sufficiently ambiguous of himself, though in his public post which is time & date-stamped 9:45AM, November 10, 2016, and ostensibly geolocated from Washington, D.C., he wrote of himself that, “I haven’t posted about the election mostly because 1) I do this for a living and most of you don’t,” which would lead one to suppose that at some level, he works in or with public policy, or more likely, with politicians.

I do not.

However, suffice it to say, that for many, many, many years, I have remained immensely interested in public policy, though I do not now, nor have I ever made my living from it, or influencing, or attempting to influence others in elected office.

In other words, I have taken the high road.

UPDATE 21September2015: Today, the John Kasich for President Campaign issued a statement denying that Rebekah Mason is working for the Kasich Campaign. The statement was issued in response to the sentence in the article below that, “[Rebekah] is reportedly working for Presidential candidate John Kasich (R-Ohio)”. Everybody is distancing themselves from Rebekah, except Governor Bentley. No one is denying that Rebekah Mason secured Bentley’s endorsement of Kasich.

Rebekah Caldwell Mason, Governor Robert Bentley’s mistress and the de facto First Lady of Alabama, is married to Jonathan P. Mason. Jonathan was a weatherman at WVUA, a small local television station in Tuscaloosa. When Bentley took office in January of 2011, however, he made Jonathan the director of Serve Alabama, which is the state agency for the governor’s faith-based programs and services.

Serve Alabama functions as the Alabama State Service Commission, granting and administering ten state AmeriCorps programs across Alabama. It is the state’s lead agency for Volunteer and Donations Management after disasters. This office serves as a liaison to the state for faith-based and community-based non-profit groups.

Serve Alabama also administered FEMA’s Disaster Case Management Program for survivors of the April 2011 storms. It administers the Governor’s Emergency Relief Fund. The office administers ReadyAlabama.gov, Alabama’s statewide disaster preparedness campaign.

That brief poem, or epigram, by Edwin Markham summarizes succinctly the idea upon which I will expound in this entry.

In the past several days, it came to light that a Shoals area Alabama entrepreneur, Garrett Shirey – who, with his brothers Reese & Austin, are founders and co-owners of Shirey Ice Cream in the northwest Alabama town of Florence, population 39,447 – had Tweeted at least two uncharacteristic and very unbecoming messages. The specific dates and times they were made, and the content can be seen in the screen shot images of the Tweets, both which appear later in this entry.

First, some background.

Inequality in Government: Is there Racism in Mississippi? In 2014? Say it ain’t so!

It occurred to me recently in a couple conversations I had with friends in various parts of our United States, that equal representation is a matter with which we still struggle.

While on occasion I’ve opined about injustice through inequality – the United States’ Constitution guarantees Equal Protection and Equal Rights under law via the 14th Amendment – it occurred to me recently that there are some who “just don’t get it.”

More to the point, I was spurred by a photograph sent to me by a friend in one of our Northern sister states – the Land of the Frozen Chosen, sometimes also referred to as “The Great White North.”

In gentleness, I refer, of course, to Minnesota.

It was a photograph of my friend’s co-worker which sparked my interest, and subsequent curiosity.

The co-worker was Afro-American, aka “Black.”

I was somewhat surprised to see a Black person in Minnesota, so I queried the Census Bureau for some Quick Statistics about our United States.

Here’s what I found:
Only 5.5% of Minnesota’s population is Black.

In comparison to the United States at large, 13.1% of our American population in general is Black. And in Alabama, 26.5% are Black, while in neighboring Mississippi, 37.4% of that state’s residents are Black. Alabama’s Eastern neighbor Georgia has a closely similar percentage with a 31.2% Black population, while Tennessee is nearly half, with a 17% Black population.

Examining some other states, I found that Alabama’s Southern neighbor, Florida has a very closely similar Black population with 16.6%, while Louisiana’s Black population is just about double with 32.4%. The “Natural State” of Arkansas has a 15.6% Black population, while North and South Carolina are almost evenly tied with 22 & 28% respectively.

On the other hand, Texas has a lower Black population than either Tennessee or Arkansas with only 12.3%.

Kentucky? Only 8.1% of Kentuckians are Black.

Interestingly, of the 16 players on the Kentucky Wildcats Basketball team, only 6 are not Black. In other words, 62.5% of the team is Black – a clear majority. And yet, the state’s general population is completely and disproportionately unrepresentative of the team.

What about Virginia? With a 19.7% Black population, Virginia stands in distinct contrast to West Virginia, which only has a 3.5% Black population – a very stark contrast, indeed.

But what about some of the other Midwestern states?

Missouri has an 11.7% Black population, while only 3.2% of corn-fed Iowans are Black.

From Minnesota moving West, South Dakota has a mere 1.7% Black population, while Montana…

Well.. there just about no Black folks in that state, at all. Only a mere 0.6% – 6/10ths on one percent – of that state’s residents are Black.

A casual observation would be that it’s mighty White up North.

But let’s bring it back on home to Mississippi…

That’s how I describe the recent ruckus & hullabaloo made about the recent UK news story that “revealed” the U.S. National Security Agency is “spying” on American citizens at home.

The reality is, that the information the NSA is creating is called “metadata,” is a set of data that describes & gives information about other data. Phone numbers called, dates, times & length of calls is NOTHING by comparison to what BIG BUSINESS knows about us already.

Why do you get certain junk mail?

Ever got junk mail from the AARP?

If you’re near age 50, or older, you probably already have.

Ever gotten junk mail from Social Security, Medicare, FDIC, or even your Congressman or Senator?

I dare say you have NEVER.

When you bought your car, if you borrowed money to purchase it, the bank or credit union which loaned the money to you performed a background credit check on you before they loaned their money to you.

Where do you think they got such information? The federal government?

Please… don’t insult my intelligence.

When you applied for a credit card, did you happen to list your age or birthdate on the application?

What about the life, health, auto, or house insurance policies you have? Did you mention your relationship status, number of children, their ages, specifics of your health including medicines, treatments, surgeries, income & source, length of residency, height, weight, or even the size, color & consistency of your last bowel movement?

I would imagine the answer to ALL those questions – at one time or another – has been “yes.”

And yet, unless you’ve served in the Armed Services, or as a

“Shadrack McGill.” Need I say more?

Shadrack McGill makes Alabama a laughingstock.

Or rather, it’s his wife who does so.

Of course, the state apparently don’t need that much help to appear as such, anyway.

By now, the whole world knows of the fracas that that the wife of Alabama State Senator Shadrack McGill (R-8th District) has caused.

What first began as a post on Senator McGill’s Facebook page has suddenly turned into a worldwide free publicity campaign.

Even the Daily Mail – a newspaper in the United Kingdom – has picked up the too-weird-to-be-true story in an article entitled “Alabama state senator’s wife lashes out on Facebook against women who are ‘soliciting her husband for sex’ after ‘strippers showed up at their house’.”

“Multiple times since being in office he has gotten emails from women (who may not even be real) inviting him to explore, also sending pictures of themselves.”

What strikes me as particularly curious is the fact that apparently neither Senator McGill nor his wife Heather made any remarks or comments of any type, kind or variety when he alleged that it first occurred, nor did he alert authorities when a suspicious knock came at his door in the dead of night.

Recently in another Social Media forum, a long-time friend had posted a link to a site operated for the Alabama State House GOP faction, which is a so-called “supermajority” in that state’s elected legislative body. That site may be found here: http://ALHouseGOP.com/WeDareDefend/.

Perceiving that that those political ideologues were very likely drumming up support for their positions based upon pure emotion and fear, rather than reasoned, rational and informed debate, I initially responded by quickly writing a somewhat sarcastic response, precisely worded to give pause for thought. My initial response elicited a query, to which I delightfully replied more eruditely.

The exchange as it exists presently, now follows.

• Me: Yeah. Alabama was wrong on their right to segregation and their right to deny civil rights, too.

• Friend: So, do you support the

Ronald Reagan: “I do believe that an AK-47, a machine gun, is not a sporting weapon or needed for defense of a home.”

History’s a funny thing, ain’t it?

FaceBook The Internet is full of false “quotes” attributed to such luminous historical figures as Benjamin Franklin, Abraham Lincoln, George Washington, Thomas Jefferson, and other Founding Fathers, along with fallacious – even mean-spirited and evil – attempted parallels to Hitler and the sitting President Barack Obama.

It’s just pure hatred. That, ignorance and selfishness.

But when it comes to one of the most iconic figures of the 20th century, a two-term Republican President held in high esteem by Democrats and Republicans alike, no one really likes to recall the things he said.

And so, here for your perusal and consideration, is an historical redux.

An International Dialogue on the Recent Tragedy of an English Nurse’s Suicide

Over the past year, I have established friendship with a young man whom is an Irish resident. We share several common interests, among them our religious faith – we are both Catholic – and the creative arts – he is an active musician, while my musical talents & skills have taken a respite.

Recently, on his FaceBook page, he had shared a news story, which was in response to the news of the tragedy of the suicide of the English Nurse who had been involved in an international prank, and later found to have committed suicide.

While the volume of dialogue was principally between he and I, there were other respondents, some of whom were situated on the opposite side of the globe, in the Southern hemisphere, in Australia, where the prank originated.

As I returned to the post to read the other responses, it occurred to me that they were civil in tenor, and it was that aspect of the dialogue which was perhaps the most enjoyable, and which – as I perceive it – has remained sorely absent in many so-called online “forums.” The lack of civility has also taken a toll in politics, even on a worldwide basis. And that loss of civility is wholly and entirely regrettable.

So, it is because of the presence of civility – which is an acknowledgement of respect for another person, even though there may be vastly differing perspectives – that I wish to share the dialogue. For respect of others’ privacy, and because their identities are not germane to the topic, their names are redacted.

I happen to enjoy friendship with a young family whose matriarch was at first, overjoyed at the prospects of their firstborn obtaining gainful employment in this tough economy.

Their son, who in this post is identified as Young Man, is a recent high school graduate, and demonstrates musical talent.

Recently she posted the following on her FaceBook page:

“Did you know if you work at McDonalds you are pretty much forced to *eat* McDonalds? 😦 The breakroom has only a table & chairs. No fridge to keep your food cool or microwave to heat it up. So, unless you are able to drive yourself to work & carry your food in a cooler in your car, then you have to eat there. Plus, you only get 30 minutes. This makes me upset! I’m trying to convince -*- to apply elsewhere…”

I found the numerous responses fascinating, which are as follows – my response is last, italicized and emboldened.

Refugee from Facebook questions the social media life

MARFA, Tex. — Not long after Katherine Losse left her Silicon Valley career and moved to this West Texas town for its artsy vibe and crisp desert air, she decided to make friends the old-fashioned way, in person. So she went to her Facebook page and, with a series of keystrokes, shut it off.

The move carried extra import because Losse had been the social network’s 51st employee and rose to become founder Mark Zuckerberg’s personal ghostwriter. But Losse gradually soured on the revolution in human relations she witnessed from within.

The explosion of social media, she believed, left hundreds of millions of users with connections that were more plentiful but also narrower and less satisfying, with intimacy losing out to efficiency. It was time, Losse thought, for people to renegotiate their relationships with technology.

“It’s okay to feel weird about this because I feel weird about this, and I was in the center of it,” said Losse, 36, who has long, dark hair and sky-blue eyes. “We all know there is an anxiety, there’s an unease, there’s a worry that our lives are changing.”

Her response was to quit her job — something made easier by the vested stock she cashed in — and to embrace the ancient toil of writing something in her own words, at book length, about her experiences and the philosophical questions they inspired.

The appointment of Ms. Mayer, who was employee No. 20 at Google and was one of the few public faces of the company, is considered a surprising coup for Yahoo, which has struggled in recent years to attract top flight talent in its battle with competitors like Google and Facebook.

Ms. Mayer, 37, had for years been responsible for the look and feel of Google’s most popular products: the famously unadorned white search homepage, Gmail, Google News and Google Images. How Hot Is It? All You Need To See Are These Two Maps

The heat wave across much of the nation continues.

We could hit 105 degrees on Saturday here in the nation’s capital, the National Weather Service says. Washington, D.C., has already tied its record for most consecutive days (eight) with temperatures of 95 degrees or more.

And as Wunderground.com writes, “more record-breaking triple-digit heat is expected Friday and Saturday across much of the Midwest and Tennessee Valley.”

The good news is that things could start to cool in just a few days. “Early next week and even this weekend we’ll see rain in Kansas and Nebraska and parts of Texas,” forecaster Bruce Sullivan of the National Weather Service, tells USA Today.

But what we want to focus on are some incredible statistics and maps from the National Climatic Data Center.

First, look at this image showing the number of places where daily maximum temperature records have been broken so far this month. According to the data center,

Even if these issues do concern you, why doesn’t FaceBook make greater, more significant efforts to inform their user base & general public?

Facebook Holds a Vote and Turnout Is Low

It has more than 900 million people. It has its own currency. And this month, for the first time, the digital republic known as Facebook held elections of a sort: it offered users a chance to vote on the way the site is governed, including how the company deploys its users’ data.

Turnout was spectacularly bad in the digital republic that the writer Rebecca Mackinnon has dubbed Facebookistan. Fewer than 350,000 Facebook users voted, or under 0.04 percent.

“Given these efforts and the subsequent turnout,” Elliot Schrage, its vice president of communications and public policy, wrote on the site, “We plan to

FaceBook jokes aside, are there GENUINE dangers in Social Media?

Slowly, but surely, there is a resounding “YES!” which is beginning to reverberate throughout the nation, in response to that question.

Recently, news reports have emerged that FaceBook‘s lawyers are seeking a way around the “Children’s Online Privacy Protection Act of 1998.” Mr. Zuckerberg’s opposition to COPPA is well-known. In a May 2011 interview with CNNMoney writer Michal Lev-Ram, when asked how he would deal with COPPA, said “Because of the restrictions we haven’t even begun this learning process. If they’re lifted then we’d start to learn what works. That will be a fight we take on at some point.”

That federal law, in essence, forbade (that is, made illegal) any effort by an online entity from collecting personally identifying information from children.

And, true to form, there will doubtlessly be laws enacted, and court cases decided that deal with issues of commerce, privacy, First Amendment rights, and other certain freedoms that we as people freely exercise.

Doubtless as well, those pushing the limits will be corporations – those “artificial” persons, which – according to the United States Supreme Court – also have the EXACT SAME RIGHTS as any real person.

And then again, there’ll be the TEA Party/Republican radicals that scream “too much government, too much regulation, smaller government, less regulation – let the free market decide!”

In essence, not only have you already become a commodity that is bought, sold & traded (think “slavery” – yes, I’m dead serious), but you will soon no longer have any rights to control the invasive eavesdropping/electronic surveillance/stalking that the companies perform against you while you peruse their websites or use their software. Suffice it to say, the information they collect about you is not yours, but rather theirs.

And just so you’ll be aware, this FaceBook problem is not exclusively limited to the United States.

Before closing this commentary, I’d like to let readers know that there are several good browser add-ons that assist privacy efforts. Among them are “HTTPS Everywhere” – by the Electronic Frontier Foundation, and “DNT+” – by Abine. Of course, Aurora by Mozilla/Firefox is a more secure browser than either Microsoft Internet Explorer, or Apple’s Safari.

Wising Up to Facebook

WHAT’S the difference, I asked a tech-writer friend, between the billionaire media mogul Mark Zuckerberg and the billionaire media mogul Rupert Murdoch?

When Rupert invades your privacy, my friend e-mailed back, it’s against the law. When Mark does, it’s the future.

There is truth in that riposte: we deplore the violations exposed in the phone-hacking scandal at Murdoch’s British tabloids, while we surrender our privacy on a far grander scale to Facebook and call it “community.” Our love of Facebook has been a submissive love.

But now, not so much. In recent weeks it seems the world has begun to turn a jaundiced eye on this global megaplatform. While that may not please Facebook’s executives, it is a good thing for the rest of us — and maybe for the future of social media, too.

The recent history of the Facebook phenomenon has been a serial bursting of illusions.

Most conspicuously, there was the

Are people really that stupid?

Wait… that’s a rhetorical question.

But this does beg the question: It’s your information, it belongs to you because it’s about you – even if you use FaceBook. Why shouldn’t you have a say in how it’s harvested & used?

Don’t Bother Posting the “Facebook Privacy Notice” That’s Spreading Around

Since late last month, Facebook users have been posting a legal-sounding “privacy notice.” By putting the notice on their timelines, they hope, they will become exempt from the terms and conditions of Facebook’s “Data Use Policy,” which users agree to upon initially signing up.

Unfortunately, that couldn’t be further from the truth. As the urban-legend-debunking site Snopes explains, “[T]he basic premise is false.”

“We have noticed this recent status update that is being widely shared implying the ownership of your Facebook content has recently changed,” Alex Kirschner, a member of Faceook’s PR team, told me. “This is not true and has never been the case.”

While there are some variations, most of the warnings look like this:

Are there good reasons to leave FaceBook?

Sure there are!

However, there are probably as many good reasons to stay.

And yet, for the good reasons to stay, there are genuine concerns, not only with governmental agencies worldwide, but with FaceBook itself.

It IS possible to almost wholesale “lock down” your FaceBook account, but one must decide if those actions are worth it, or not.

Further, another option is, that one could delete everything that could be deleted from FB – likes, comments, posts, etc. – and make invisible those things that cannot be deleted.

Of course, there’s no reason one could not have more than one FB account, either.

However, with all this, it might be wise to consider the ultimate in security, which was proposed several years ago: Public Key Encryption.

Is it clear enough that Wall Street denizens like neither FaceBook or Mr. Zuckerberg?

They bitched, moaned, groaned, griped, carped and complained about his attire.

To be certain, this is not a reflection upon Mr. Zuckerberg’s character, but rather a form of criticism of his company’s business model. Nasdaq ‘embarrassed’ over Facebook IPO

Nasdaq OMX‘s chief executive admitted he was “embarrassed” by the delay in the opening trade of Facebook’s initial public offering and revealed that the exchange was in talks with regulators over potentially millions of dollars of customer claims.

Bob Greifeld said on Sunday that the 20-minute delay in trading of Facebook’s $16bn offering on Friday had been caused by a millisecond systems blip due to the largest IPO auction “in the history of mankind”.

The exchange has found itself in the spotlight after Facebook failed to deliver a first-day “pop” to investors, instead almost falling below its issuing price of $38. The shares, having risen briefly, quickly fell away to close the day with a gain of just 0.6 per cent, at $38.23.

As a result of the trading delay, Nasdaq was left with a position in Facebook shares that it was forced to liquidate, according to its own rules, generating $10m for the group. It plans to use that money, plus potentially more, to resolve disputes related to 30m shares that may have received improper trades.

A competition probe into Facebook’s $1bn acquisition of photo-sharing service Instagram threatens to postpone the closure of the deal beyond the second quarter, the target set by the company in its initial public offering documents.

The Federal Trade Commission has launched the investigation, according to two people familiar with the matter, and has already begun collecting information from at least one of the social network’s largest competitors. The process could also further slow Facebook’s already lagging mobile strategy.

The competition probe – routine for any deal more than $66m – is likely to take six to 12 months, according to several experts. But Facebook said in its IPO documents last month that it expected the deal to close in the second quarter.

“That’s terrifically optimistic,” said David Balto, a former policy director at the FTC who now works as an anti-trust lawyer.

Competition experts expect that the Instagram merger will ultimately be approved, but they believe regulators will apply close scrutiny to the deal because of the steep price that Facebook paid and the high profile of the companies.

“They’re going to want to take some months to investigate and understand the market and other players,” Mark Lemley, a professor at Stanford Law School, said. “And there may be more parties with an interest in submitting information.”

Sure, money is power. But, is it also liberty and freedom? Or, is it a tool?

As Bob Dylan sang some years ago, “The times, they are a-changin’.” Our laws should reflect those changes while adhering to the values ensconced in our Constitution. In essence, the argument is about freedom – freedom from the large corporations that supply “content” via the Internet. As well, openness and honesty – popularly termed as transparency – should be the hallmark of all dealings, by government and enterprise.

In short, what we’re encountering in this age, in this era, is an almost unprecedented and wholesale onslaught of money and the power that comes with it. It is, in essence, a corrupting influence. It is, in essence, a type of bribery – and bribery is itself, a form of theft. Bribery is a form of theft because it takes away, removes, or forbids resources from going where they ought, or rightfully should. In this case, it robs freedom from the people. Not only does it usurp their decision-making capacity, it is a blatant announcement and condemnation of freedom, because it says that the rich, the wealthy have freedom, while the poor and disenfranchised have none.

If – as the Supreme Court has declared – money is the equivalent of free speech, and neither cannot, nor should not be limited, what freedom does the poor man have? Again, if money is equated with free speech (that is, our First Amendment rights), the poor man has none. And that, my dear readers, is but one reason why such a ruling is not only ANTI-Constitutional, but is antithesis of freedom.

Making a further case, our nation’s specie – that is, the currency and coinage – is the property of the United States government. It is NOT private property. Money is a thing used to represent something else. So again, I ask rhetorically… in such instances, and in this case, what does it represent?

Who can forget then-candidate Ronald Reagan’s classic line at the 1980 New Hampshire candidate’s debate:  “I’m paying for this microphone!”  And Google probably is wishing that whichever Ivy League idiot thought of rebranding their anti-SOPA campaign site with the double entendre “It’s Our Web” had not been quite so…uh..transparent…about it all.

Are Travel Agents Back?

THE complimentary wine and fruit platter was sent up to Jessica Griffin and her family moments after they strolled into their roomy suite. They were accompanied by a bellhop who placed their bags near a tidy crib made up with luxurious, high thread-count sheets for Ms. Griffin’s 1-year-old daughter.

The V.I.P. treatment at the Cheeca Lodge and Spa in the Florida Keys last month hadn’t come with an extra cost. In fact, Ms. Griffin said, she paid about $100 a night less than the standard rate for her room. And the deal wasn’t the result of hours of tedious online research either. She had finagled her savings the old-fashioned way: through a travel agent.

“I needed recommendations and someone to steer me in the right direction,” said Ms. Griffin, who opted to work with an agent after years of making her own reservations because she needed a getaway suitable for a toddler and had little interest in scrolling through endless and conflicting user hotel reviews online. “There are so many,” she said. And with every site displaying beautiful pictures and tantalizing offers, “it can be overwhelming.”

“I wanted somebody from a reputable agency who could say yes, you’ll enjoy this stay,” she said.

According to those in the travel agent industry, clients like Ms. Griffin are not alone, and are in fact helping to stanch the bloodletting the industry has experienced since the onset of D.I.Y. booking more than a decade ago. Some bloggers censor, censure, limit & forbid comments. I don’t.

I may take a different tack than some bloggers, and I have only in extreme cases (translate: virtually never) blocked, deleted or censored comments.

The reason why is rather simple.

And it is, that often, the comment says more about the commenter than the topic.

Sure, some folks have written nasty, vile & vitriolic commentary upon some entries posted here, but fortunately, they are the exception, rather than the rule.

Even if a topic is hotly debated, discourse should be civil, though the bane of many forums is that remarks upon them are not.
