In America, you can get arrested for drinking a beer in public.

In Germany, one can legally walk around in public while drinking a beer. To do so is neither illegal, immoral, or unethical.

Of course, illegality, immorality, and unethical behavior are three entirely separate, and unique things. Suffice to say, they’re not the same.

In America, one cannot walk around in public while drinking a beer, or any other alcohol-containing beverage. In many, if not most, places, it’s illegal to do so – save, perhaps, for a few specially-designated areas, or upon certain occasions in those areas.

For example, it’s not uncommon to see pictures, or read news stories of college-aged students who can otherwise legally consume alcoholic beverages (being aged 21, or older), and even adults, who while enjoying almost any public beach in America, are accosted by local law enforcement authorities who either confiscate, or demand that the beer owner(s) destroy those ice-cold beverages by pouring them out, and sometimes, even arrest them, haul them off to jail, where they’re fingerprinted, photographed, and incarcerated, however briefly, as if they’re genuine threats to society, or had committed some grievously atrocious felony.

Of course, it almost goes without saying, that if anyone, anywhere in America was walking around in their local Wal-Mart, shopping while drinking a beer, the police would be called to the scene, and doubtlessly, the shopper/drinker would be arrested, and the story of it published on the worldwide web of the Internet for all the world to see.

Typically, in most all such instances, those individuals would be violating so-called “open container” laws, which forbid the public consumption of alcoholic beverages.

Yet interestingly enough, morbidly obese people can walk around in public eating hot dogs, doughnuts, and junk foods of seemingly innumerable variety and type, wash it all down with gallons of soda pop, and it’s not illegal to watch them commit their slow suicide in public, and no one dares think about calling the cops on them.

Defendants cry foul on definition of ‘animal’ in cockfighting trial

MOULTON — Jury deliberation will continue today in the trial for five men facing charges in connection with the raid of a cockfighting operation in August 2011.

On trial are Joseph Lynn Holmes, 36, of Hanceville; Larry Dale McCroy, 53, of Hanceville; Zackary Clay McLeroy, 33, of Cullman; James Russell Garnett, 34, of Vinemont; and Grady Darrel McCroy, 54, of Cullman. All face charges of cruelty to animals and gambling on cockfighting.

Testimony began Tuesday and concluded with only one witness being called, Lawrence County Drug Task Force investigator Shannon Holland. Holland testified that through a confidential informant, he received information about a cockfight held at the edge of Bankhead National Forest at a residence off Lawrence County 81.

He said that, as an undercover investigator, he attended the event held in a barn Aug. 6 through Aug. 7. He said an admission charge was required to enter, and gamecocks fought in an octagon-shaped ring with bleachers and chairs on both sides. He testified he saw several dead and injured gamecocks and saw all the defendants handling the birds before or during fights.

The jury viewed video Holland captured on his cellphone of a cockfight and of injured birds.

Toward that end, it very much appears that for many years, AT&T Mobility has – in violation of applicable federal, state and/or local law(s) – independently taxed Internet service it provided to smartphone owners – such as the iPhone, Blackberry, Palm, etc.

Thus, if you have ever used any AT&T Mobility Internet service – whether you have ever owned a smartphone or not (there are numerous cell phones that can access the Internet, even though they’re not categorized as “smartphones”) – you are a member of a class, and are entitled to a settlement.

Honesty… is it ALWAYS the best policy?

Recently, I’ve found that some search engine terms which have led to this blog include this question “Why do you want to work at Huntsville Hospital“?

In Huntsville, Alabama – where I resided for many years – there are ONLY TWO hospitals in town.

One, Huntsville Hospital, is a public not-for-profit, and the other, a much smaller Crestwood Medical Center, is a private, for-profit hospital.

Many of the professors and instructors at the Nursing School from which I graduated have privately expressed their frustrations to their students, and to me, about Huntsville Hospital’s virtual monopoly on the hospital-based healthcare delivery in Huntsville, AL.

Part of that problem stems in large part from

The following is one of the typical e-mail “you must do something now!” kind of messages that so many of us receive in our e-mail in boxes.

In such typical fashion, they are either contain a type of ‘the world is going to end’ (and soon, if you don’t act now!), or either “the sky is falling!,” type of message.

While the motivation for the message, or the idea behind them may – at times – be worthwhile, often the delivery is suspect.

Following is the message, and – NOT TO BE MISSED – is

Some “are more equal than others.”

American manufacturing has taken flight to overseas locales thus contributing to our nation’s overall, (and in my opinion) abysmal decline.

The problem is systemic.

A very wrong-headed and misguided political theory has emerged in our nation, which has been, and continues to be promulgated by and through various outlets, including but not limited to governance, private enterprise and most especially by Protestant religious adherents, predominately of the non-traditional inter/trans/non denominational variety.

It is the promotion of the so-called “Prosperity Gospel” – the message of which in essence says “you too can be rich,” but only if you do what I say, and give a generous donation, then you will be “blessed” with good fortune.

It is – contrary to what its adherents may claim – an extraordinarily self-centered ideology, one which is philosophically based upon the idea of increased materialism, or consumption. Essentially, it is heresy, for it contrary to the Christ’s teachings. The “me and what I want” value structure of society has not served humanity well, and in fact, never has.

The pressure to choose their own interests and concerns above and over, and to the exclusion of the just rights, expectations and legitimate needs of others in the community, state and nation is what makes such a philosophy evil. It is essentially contrary to our nation’s constitution and the principles upon which it was founded and established.

When those more powerful than you or I (meaning the über-wealthy, and increasingly their denizen corporations and armies of corporate lawyers) have the ability to wage war against the common man (the average citizen) and the so-called “level playing field” upon which they make the rules, there is no “game,” no competition, no sense of inherent justice or fairness, and certainly no equality.

They are, as the George Orwell novel “Animal Farm” intoned, “more equal than others.”
