Texas’ Republican U.S. Senator Ted Cruz Blasting Twitter CEO Dorsey Proves He’s A Dingaling

Seems ol’ Teddy Boy got hot under the collar at Twitter CEO Jack Dorsey during a Senatorial hearing today, Wednesday, 28 October 2020, which was conducted remotely because of the coronavirus pandemic.
Frustrated at the responses, Ted Cruz screamed out at Twitter CEO Jack Dorsey,
“Who the hell elected you? Why do you persist in behaving as a Democratic super PAC, silencing views to the contrary of your political beliefs?”
Ol’ Ted should remember that “Freedom of Speech and of the Press” (First Amendment Rights) do NOT apply to businesses.
Only to the government.
The Press – and for all practical purposes, Twitter is considered part of the Press – is free to publish, or not, what they want. They are free to censor as much as they like, or not.
In 2018, in a 5-4 ruling in the case “MANHATTAN COMMUNITY ACCESS CORP. ETAL. v. HALLECK ETAL.,” the Supreme Court ruled that
“The Free Speech Clause of the First Amendment prohibits only governmental, not private, abridgment of speech.”
The majority opinion was written by Justice Brett Kavanaugh, and was joined by “ROBERTS, C. J., and THOMAS, ALITO, and GORSUCH, JJ.,” which ruled that because of it’s non-governmental status, the private not-for-profit corporation was NOT subject to the constraints of the First Amendment.
“Providing some kind of forum for speech is not an activity that only governmental entities have traditionally performed. Therefore, a private entity who provides a forum for speech is not transformed by that fact alone into a state actor.”
Readers SHOULD recall that Alan Dershowitz, a Harvard Law professor who taught Cruz, in an April 6, 2014 interview with the Philadelphia Inquirer called him “off the charts brilliant.”
“Off-the-charts brilliant. And you know, liberals make the terrible mistake, including some of my friends and colleagues, of thinking that all conservatives are dumb. And I think one of the reasons that conservatives have been beating liberals in the courts and in public debates is because we underestimate them. Never underestimate Ted Cruz. He is off-the-chart brilliant. I don’t agree with his politics.”
Frankly, Senator Cruz seems to have forgotten the recent lessons of history.
So, if ol’ Ted, aka “Mr. Off-the-Charts-Brilliant” doesn’t like it, he should just shut his gaping pie hole.
If you’ve not seen the 9-minute clip, or read about it, here it is from C-SPAN.
